Why does access not mean permission to use the service?

- Local law and regulation: The technical ability to submit an order, receive a deposit address, or complete an on-chain transfer is not a legal determination. A successful quote returned by the interface does not establish that a particular user or transaction complies with mainland China rules.
AllSwap's terms do not list “mainland China” as a separate entry in a country-by-country blacklist. That absence is not permission to use the service. The condition barring use where local applicable law prohibits it is a separate and continuing eligibility requirement. Similarly, the terms' selection of Hong Kong SAR law as the governing law of the contract does not automatically displace mandatory laws that apply where a user is located.
What does the 2026 Chinese regulatory notice say?
On February 6, 2026, the People's Bank of China and seven other authorities issued the Notice on Further Preventing and Addressing Risks Related to Virtual Currency and Other Activities (Yin Fa〔2026〕No. 42). The notice states that conducting exchanges between fiat currency and virtual currency, exchanges between virtual currencies, or information-intermediary and pricing businesses for virtual-currency transactions within mainland China constitutes illegal financial activity and is strictly prohibited. It also provides that overseas entities and individuals must not illegally provide virtual-currency-related services to onshore subjects in any form.
The notice took effect on its publication date and replaced the relevant 2021 notice. It further explains that when investments by any entity or individual in virtual currency or related financial products violate public order and good morals, the relevant civil juristic acts are invalid and resulting losses are borne by the investor. Conduct suspected of disrupting financial order or endangering financial security is subject to investigation and action by the competent authorities under law.
The precise conclusion is therefore not that every individual's act of clicking a website necessarily constitutes a crime. Nor would it be accurate to assert that every kind of individual conduct produces identical liability. Legal consequences depend on the facts, including the user's identity and location, the purpose of the transaction, source of funds, and whether the person operates or assists in providing a service. The notice nevertheless makes one boundary clear: AllSwap cannot treat website accessibility as a guarantee that use by people in mainland China is lawful, and users must not infer permission to swap from technical availability.
Do no-KYC, non-custodial service, or a VPN change the answer?
No. No-KYC means that AllSwap's standard swap flow does not require account registration or the upload of identity documents. Non-custodial describes the service's asset-handling and order-routing model. Neither is an exemption from applicable law, and neither removes a user's responsibility to comply with the laws of their location.
A VPN, proxy, or Tor does not change the user's actual location, the applicable law, eligibility under AllSwap's terms, or potential legal liability. AllSwap does not advise users to bypass network, regional, or regulatory restrictions, and this article does not provide instructions for doing so. Even if a connection method restores access to the site, the ability to select assets, obtain a quote, or view a one-time deposit address does not establish that the transaction is permitted.
How should a user in mainland China assess the situation?
- Do not treat an interface response as an eligibility decision. Loading the homepage, browsing available assets, or generating a quote is a technical result, not compliance approval.
- Stop and verify before paying. If you are in mainland China or may be regarded as an onshore subject, do not create or pay an AllSwap order unless a qualified legal professional who understands the latest Chinese virtual-currency rules has advised on your specific circumstances and intended conduct.

What should you do if you have already paid or an order is abnormal?
If an order has already been created, do not send additional funds to any address for purported “unfreezing,” “address verification,” or “credit replenishment.” Do not trust third parties who claim they can unfreeze funds, reverse an on-chain transaction, or bypass a review. Keep the order ID (orderId), the one-time deposit address, the source-chain transaction hash (TxID), asset and network details, the amount, and the payment time.
